These terms and conditions are to be deemed included in all orders accepted by us:
1. Terms: Net 30 days.
2. Prices are F.O.B. Lockland, Cincinnati, Ohio.
3. Unless otherwise specified, prices cover carbon (.20%-.50%) steel castings only, in an annealed condition, suitable for machining. They are based on normal test requirements and do not include the use of, or rejection by, Magna-Flux, Gamma-Ray, X-Ray, Ballistic Tests or any other destructive or non-destructive methods of inspection.
4. Our quotations or prices apply to castings produced to commercial standards. Extra charges are applicable to castings made to special tolerances, of special analyses, test bars when required, or to meet special inspection or specifications of any kind.
5. Whenever the shipping weight of an order or item of an order is less than 100 pounds, the cost of processing such an order or item will necessitate the usage of a special price or minimum billing.
6. While in some instances estimated casting weights are indicated in a pricing quotation, such weights are not to be considered a basis for invoicing. Actual shipping weights will apply.
7. We will replace or repair castings rejected due to defective workmanship and/or materials, but assume no responsibility or liability for consequential, special or contingent damages attributed to such castings.
8. We will not accept back charges for welding or any other work performed by the customer, unless each job or case has been first brought to our attention and such back charges separately and individually agreed to by us. 9. We assume no responsibility for machine work, labor charges, or other expenses incurred by the purchaser on castings which are later rejected as defective.
10. At any time, should labor and/or material costs so warrant, our prices are subject to change. The revised prices will apply to shipments against orders then on our books.
11. When the delivery requirements of an order necessitates intermittent production or shipment, the price applying to each requirement or shipment will be used.
12. When the average weight of castings in any shipment of an item is less than one pound, the castings will be billed as one pound each.
13. The cancellation of any order prior to its completion will result in the invoicing of accrued production costs, including burden and overhead.
14. Prices are based upon pattern equipment suitable for our use, and do not include charges for pattern
work.
15. We accept no responsibility for the dimensions of castings if the purchaser has not consulted with us and followed our recommendations as to the necessary finish and shrinkage allowances, and other pattern design requirements which we consider necessary.
16. We assume no responsibility for the cost of repairs or replacements to purchasers' patterns and core boxes resulting from normal usage. Active pattern equipment is stored for mutual convenience. if equipment is not used for three years, it will be considered inactive and will be returned upon notification. All reasonable care is taken in the
handling, use, storage and protection of this equipment. However. insurance against loss by fire or other casualty is the responsibility of the customer. Transportation costs of the delivery of patterns to and from the foundry, including the cost of crating and handling, are to be paid by the customer.
17. The standard carbon range is 10 points. (.10%) and if we are restricted to a lesser range, the item will be considered to be of special analysis subject to extra charge.
18. The minimum range for Brinell hardness is 50 points. When Brinell hardness only is specified, the extra or sum of the extra charges, for whatever alloy, carbon content or heat treatment, or combination of them, is required to obtain the specified hardness, will be applied.
19. All prices quoted are subject to increase by the amount of any sales tax, or other tax measured by the sale which we may be required to pay or collect upon the sale. If purchases are sales tax exempt, please furnish exemption slip with order.
20. Every effort will be made to maintain delivery schedules as established. However, we are not responsible for the failure to fill, or for delay in filling an order, when due to fire, strikes, accidents, labor troubles, trade embargoes, shut-downs, or any other cause beyond the Company's reasonable control.
